These Terms and Conditions (“Terms”) govern your access to and use of the Netyex B2B marketplace (referred to as “Netyex,” “we,” “us,” or “our”). By accessing or using our platform, you agree to be bound by these Terms. Please read them carefully.
- Acceptance of Terms
By registering, browsing, or transacting on Netyex, you confirm that:
- You are legally capable of entering into a binding contract.
- You are using the platform for business/commercial purposes only.
- You agree to comply with these Terms, our Privacy Policy, Shipping Policy, and Payment Policy.
- Platform Usage
- Netyex is an export-centric B2B sourcing marketplace connecting global buyers with pre-vetted Indian suppliers.
- All buyer-supplier communications, negotiations, and orders are facilitated through our platform.
- We manage the sourcing process end-to-end, including quality checks, export compliance, and shipping coordination.
- Registration & Account Security
- Users must register using valid business details and maintain confidentiality of account credentials.
- Netyex reserves the right to verify business identity and reject or suspend accounts deemed fraudulent or non-compliant.
- Order Process
- Orders are placed upon mutual agreement on pricing, product specifications, and Incoterms (FOB, CIF, EXW, etc.).
- Once confirmed, orders are binding and cannot be canceled unless mutually agreed in writing.
- Payment Terms
- Netyex operates on advance payment terms. We do not offer credit.
- All payments must be made via approved international methods (Bank Transfer, LC, or other compliant routes).
- Prices are exclusive of applicable taxes, duties, freight, and insurance unless otherwise stated in the invoice.
Payment Flow:
- Proforma Invoice shared upon order confirmation.
- Production/shipping begins only after payment receipt.
- Final invoice and shipping documents are shared post-dispatch.
- Shipping & Delivery
- Netyex supports Incoterms such as FOB, CIF, EXW, and DDP depending on the buyer’s preference and agreement.
- Buyers may choose between:
- Express Delivery
- Sea Freight or Air Freight
- Warehouse pickup (if locally available)
Important Shipping Notes:
- Transit timelines depend on destination, shipping mode, and customs clearance.
- Netyex is not liable for delays caused by customs, port congestion, or unforeseen global events.
- Product Inspection & Quality Assurance
- Netyex conducts pre-dispatch quality checks as part of our sourcing responsibility.
- Any quality discrepancy must be reported within 7 days of goods receipt, along with supporting evidence.
- Refunds/replacements are handled case-by-case based on contract terms and product category.
- Supplier Engagement
- Netyex maintains a curated supplier base but does not disclose buyer details to suppliers unless necessary.
- We do not operate on a commission model; instead, we add a transparent sourcing margin to supplier prices.
- Intellectual Property
- All platform content including product listings, descriptions, logos, and trade names are owned by Netyex or its licensors.
- Users may not reproduce or reuse any content without written permission.
- Confidentiality & Data Use
- Netyex ensures all user data is handled per our [Privacy Policy].
- Buyer and supplier data is used solely for matchmaking, communication, and order facilitation.
- Limitation of Liability
- Netyex is not liable for:
- Losses due to force majeure events.
- Buyer-side errors in order specifications.
- Delays caused by third-party logistics or customs.
- Dispute Resolution
- All disputes will be handled professionally with a goal for amicable resolution.
- In case of unresolved matters, disputes shall be governed under Indian law and subject to jurisdiction of courts in Noida, Uttar Pradesh, India.
- Modifications
- Netyex reserves the right to modify these Terms at any time. Updates will be posted on the platform with an effective date.
